Dr. Chacon Has Pleaded Not Guilty to Crime Charges
When Dr. Chacon was accused of killing Megan Espinoza, he pleaded not guilty in April 2023. Megan sadly passed away a few days after having a heart attack after getting breast implants.
When Espinoza died, Dr. Chacon was first charged with killing by accident. According to the San Diego Union-Tribune, the charge was raised to second-degree murder after it was found that Dr. Chacon did not call 911 for three hours and even took care of other possible patients while Espinoza was in terrible pain.
Gina Darvas, a deputy district attorney from San Diego County, says that Dr. Chacon stopped other people at Divino Plastic Surgery from calling for help in an emergency.
After Dr. Chacon was arraigned on April 10, Darvas told reporters on KGTV, “The defendant basically doubled down on his practices and stopped other people from calling 911. He then let Ms. Espinoza suffocate for three hours before emergency personnel were finally called.”
The second-degree charge was added by the prosecutors because they say Dr. Chacon had a “conscious disregard for life.”
Divino Plastic Surgery Nurse Charged
Heather Lang Vass, a registered nurse who helped Dr. Chacon during the treatment and is also charged with Espinoza’s death, has also been named. In May 2023, she admitted to killing someone without meaning to.
Anesthesia for Espinoza was given by a nurse instead of a licensed anesthesiologist, according to a report from the Medical Board of California (MBA) from 2022 that was used by KGTV. Espinoza’s heart stopped beating after the two-hour surgery was over. Instead of calling 911 right away, Dr. Chacon talked to two anesthesiologists.
