In a Facebook post on Friday, February 23, 2024, Assemblyman Robert Smullen said that his son was seriously hurt in a crash on Thursday, February 22, 2024. He wrote:
“Megan and I need your prayers, our son AJ was grievously injured in an accident yesterday while playing with some of his friends. He is in critical but stable condition in the Pediatric ICU at Albany Med after emergency surgery. Thank you for your support, AJ is a fighter and needs all your love.”
His post said that his son, whose age could not be found, was in critical but stable condition at Albany Medical Center Hospital after having surgery right away.

Smullen has the backing of hundreds of people, such as the Gloversville Public Library, the Fulton County Regional SPCA, Assemblyman Brian Miller (R-New Hartford), and Assemblywoman Gina Sillitti (D-Port Washington). Rob Ortt, the minority leader in the state senate, tweeted:
