Tiktok Immune From Lawsuit Over Girl’s Death From ‘blackout Challenge’

TikTok Inc won the dismissal of a lawsuit accusing it of causing the death of a 10-year-old girl by promoting a lethal “blackout challenge” on its video-based social media platform that pushed individuals to suffocate themselves.

U.S. District Judge Paul Diamond of the Eastern District of Pennsylvania decided on Tuesday that the corporation was exempt from the case under a provision of the federal Communications Decency Act that protects publishers of others’ work.

“The wisdom of giving such protection should be addressed by Congress, not the courts,” Diamond said.

Judge Dismisses Lawsuit Claiming Tiktok’s “Blackout Challenge” Killed a Girl!

Tawanna Anderson’s lawyer, Jeffrey Goodman, stated in a statement that the family would “continue to battle to make social media safe so that no other child is killed by the reckless behavior of the social media industry.”

TikTok did not reply quickly to a request for comment.

Anderson sued TikTok and its Chinese parent firm ByteDance Inc in May, alleging that the business’s algorithm suggested the blackout challenge to her daughter, Nylah Anderson.

According to the lawsuit, Nylah attempted the blackout challenge in December 2021 using a handbag strap strung in her mother’s wardrobe, losing consciousness and sustaining significant injuries. She was taken to the hospital, but she died five days later.
