Mohsin Shaikh murder: HRS chief Desai’s provisional bail plea rejected

Pune: Government pleader Ujjwala Pawar on Wednesday said there was ample proof of Dhananjay Desai’s role in the murder case during argument and opposed the provisional bail for him. Hindu Rashtra Sena (HRS) chief Dhananjay Desai is a prime accused in the 2014 murder of IT professional Mohsin Shaikh.

Ms. Pawar, who commenced her arguments earlier this week, has taken over as prosecutor after Ujjwal Nikam stepped down in June as special public prosecutor (SPP) in the case. Desai is now seeking provisional bail of four weeks on medical ground although his bail pleas have been rejected in the past. Adv. Milind Pawar, the lawyer of Desai said that the accused was in poor health and was not getting adequate treatment in jail. He also said that there was no conclusive evidence to prove Desai was present at the crime scene and had delivered a communally inflammatory speech.


Ms. Pawar in her counter argument said that there are enough medical facilities where Desai was currently lodged and he could be treated at Sasoon Hospital if necessary. She said investigators had pointed to a conspiracy, and the charge sheet stated Desai had ‘malafide intentions’ in instigating his activists to violence. Desai is known to make inflammatory speeches and distributing communally sensitive pamphlets, Ms. Pawar added.

Maharshtra Chief Minister Devendra Fadnavis agreed to Ms. Pawar’s appointment last month after the Shaikhs wrote to him about delays in the appointment of advocate Rohini Salian as SPP in the case.

Mohsin Shaikh, 28, a Pune techie was on his way home after night prayers when he was allegedly beaten to death by right-wing outfit, Hindu Rashtra Sena (HRS) on June 2, 2014 at Satav plot in Hadapsar. The violence is linked to an objectionable post on the social media.

Pune police had filed a 650-page charge sheet naming 23 people, including Desai in August 2014. Till date, 17 of the 23 accused in Shaikh’s murder have been released on bail, and charges are yet to be framed.

While talking to theshahab.com Social Activist and Mohisn Shaikh murder case intervener Azhar Tamboli said that Additional Sessions Judge R. N. Sardesai has rejected the provisional bail plea. Starting from August 31, court heard the arguments from both sides and ultimately today court has rejected the provisional bail plea of Hindu Rashtra Sena chief Dhananjay Desai, he added.

Special public prosecutor Adv. Ujjwala Pawar, Adv. Saifan Shaikh from the intervener side and Adv. Hafizuddin Kazi from Mubin Shaikh (Brother of Mohsin Shaikh) side are representing Mohsin murder case.
